Any sale contracted electronically with our company MAISON MASARIN on the site  www.maisonmasarin.com   is subject to these general conditions of sale. For any additional information, the customer can contact the Customer Relations Department at this email address: hello @maisonmasarin.com

The site  www.maisonmasarin.com   is reserved for consumers. The purchase of product(s) by a professional for resale is prohibited.

In addition, the customer receives the information provided for in articles L 121-18 and L 121-19 of the consumer code, before and after the conclusion of the sale and in particular by these general conditions of sale which he declares to have read. before the validation of his order and to which he has access from the site  www.maisonmasarin.com

The photos of the items for sale on the site  www.maisonmasarin.com   have no contractual value and are likely to vary slightly from the items themselves.

ARTICLE 4 – PRICE AND CONDITIONS OF VALIDITY


The prices of the products sold on the site  www.maisonmasarin.com   are indicated by article and reference and include all taxes (TTC) excluding delivery costs. At the time of validation of the order, the price to be paid by the customer means the all-inclusive price, i.e. the sum of the price including VAT of the items that make up the order plus delivery costs._cc781905-5cde-3194-bb3b- 136bad5cf58d_

The conditions for the period of validity of our product and price offers are determined by the updating of the site when our collections or our promotions are released and remain applicable as long as they remain accessible by us.

The products for sale on the site  www.maisonmasarin.com   are available within the limits of available stocks. If one or more items ordered are no longer available, the customer will be informed by e-mail as soon as possible. The customer will then have the choice between keeping the rest of his order or canceling it in full. If the customer's bank card has been debited, the refund of the amount concerned will be made by crediting the bank account corresponding to the bank card used for payment within 30 days at the latest.

Sale prices are valid on a selection of items listed on the e-shop, while stocks last. The offer is valid in France only on the e-boutique  www.maisonmasarin.com

ARTICLE 5 – STEPS IN THE CONCLUSION OF THE SALE


1- Add the items to your basket.
2- Complete the order form.
3- Check the elements of your order, identify and correct any errors made during entry.
4- Validate the order, the total price and the all-inclusive price, by clicking on "Pay my order", which implies acceptance of the General Conditions of Sale of Maison Masarin.
5- Follow the instructions of our banking partner's payment server to pay for your order. Your bank account is debited with the all-inclusive price including the total price of the items shipped and delivery charges.
6- You will receive electronically an acknowledgment of receipt confirming your order.
7- You receive your package at the delivery address you indicated when placing your order.

During the establishment of the account opening form, the communication of his personal data, his bank card number and the confidential data relating thereto and the validation of the order, the customer undertakes to respect the these contractual conditions pursuant to article 1316-1 of the civil code.

Maison Masarin may refuse to honor any order that is abnormal or abusive.

ARTICLE 6 – SECURE PAYMENT


The payment of the customer's purchases is made by payment card with our payment partner Stripe, or by PayPal account.

Payment by credit card via Stripe:

It is not necessary to have a Stripe account to use this payment method.

Payment will be made from your credit card, with the Stripe system, completely secure.

The Stripe system accepts the following cards: Visa, MasterCard & American Express.

You will need to enter your banking information on the payment interface: the 16 digits on the front of your bank card, its expiry date and the 3-digit cryptogram on the back.

The Stripe service will verify the transaction and then send us your payment. We will never know your banking information. This system remains perfectly secure.

Payment by PayPal:

To use this type of payment, simply use your Paypal account if you already have one or create a Paypal account.

If you wish to open a Paypal account, the opening is free and allows you to make your payments in complete security.

Once your Paypal account has been created, to proceed with the payment of your order on our site, you will need to enter your email address and your Paypal password when they are requested. You will then be redirected to the Paypal interface which will verify the transaction and then send us your payment.

We will never know your banking information. This system remains perfectly secure.


In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay given by means of a payment card is irrevocable. 

To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on this bank card to be debited is indeed his.

ARTICLE 7 – SHIPPING AND DELIVERY


For any order placed on   www.maisonmasarin.com , we undertake to prepare your order within 48 to 72 working hours and a maximum of 4 working days during busy periods (Christmas, sales, etc.) .

When entering his order, the customer must choose the delivery method offered on the e-shop site and the place of delivery:
– Colissimo
–DHL Express

In case of absence during a Colissimo delivery to the address indicated by the customer, the package is left in the customer's mailbox. If this is not possible, a notice of passage is normally filed by the carrier: the customer can then collect his package from the post office with an identity document within 10 days of the date of filing of this notice. After this period, the package will be returned to the sender, who will refund the order within 10 working days of receipt of the return of the package.

The customer can follow the progress of the processing of his order in the "My order" tab, then "Track my order". If the order has been sent, Maison Masarin will provide a parcel tracking number to the customer, who can then track its delivery by visiting the websites made available by Colissimo: https://www.laposte.fr/outils /track-your-shipments

Each delivery is deemed to have been made as soon as the product is made available to the customer by the carrier, materialized by the delivery tracking offered on the Colissimo websites mentioned above.

If 5 working days after the shipment of the package, the customer has no news of his order, he must contact the post office closest to the place of delivery. If neither the post office nor the delivery tracking system offered on the Colissimo websites and mentioned above claim to have a trace of this package, the customer must then contact the company MAISON MASARIN through the Service. Customer Relations at the address hello@maisonmasarin.com which will then open an investigation with the postal services. La Poste's final response times vary from one to four weeks from the time the file is taken into account by the services of MAISON MASARIN. 

In the event of non-delivery due to an incorrect address provided by the customer, or any other cause of his own (absence of name on the mailbox, lack of information, etc.), the package will be returned to MAISON MASARIN by the carrier, and the order will be refunded upon receipt.

The following are considered in particular as cases of force majeure releasing MAISON MASARIN from its obligation to deliver: war, riot, fire, flood, strikes, accidents, impossibility of obtaining supplies, etc.

In any case, the delivery of our products on time can only occur if our buyers are up to date with their obligations towards us.

It is up to the customer to check the shipments on arrival and to make any reservations and complaints that appear justified, or even to refuse the package, if it is likely to have been opened or if it bears obvious traces of deterioration. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within 3 working days, not including public holidays, following the delivery of the products, a copy will be immediately sent to the company MAISON MASARIN. Failure to file a complaint within the said deadlines will extinguish any action against the carrier in accordance with the provisions of Article L 133-3 of the Commercial Code.

The customer must ensure that the items delivered to him correspond to his order. In the event that the items delivered do not conform in kind or in quality to the specifications indicated in the delivery note, the customer must inform the MAISON MASARIN Customer Relations Department by email: hello @maisonmasarin .com and return the articles to the address and under the conditions provided for in article 8.

ARTICLE 8 – RETURN POLICY


In accordance with articles L 121-20 and following of the consumer code, the customer benefits from a reflection period of fourteen clear days from the delivery to reconsider his decision and return the ordered article without having to justify reasons. nor to pay penalties.

The return costs are at our expense only in metropolitan France.

From international and DOM TOM, return costs remain the responsibility of the customer.

For  a return outside the European Union you will have to pay customs fees before shipment, otherwise your package may be returned to you, as we cannot bear these costs upon receipt.

Beyond this period of 14 days, as evidenced by the postmark, your return cannot be accepted.

When several items ordered on the site  www.maisonmasarin.com   have been shipped at once (by single package) and the customer decides to return the items that would not be suitable in a single return shipment, the return costs will be offered to him. In the event that the customer decides to make several shipments, the return costs from the 2nd shipment will be borne by the customer.


In all cases, items must be returned in their original packaging, complete, labelled, new, unworn, unwashed and accompanied by the carefully completed return slip, to the following address:

Returned items that do not meet the conditions listed above (return in their original packaging, properly folded, complete, labeled, new, unworn, unwashed) or that are rolled up, damaged, damaged, deteriorated or soiled by the customer will not be refunded.

The risks of return are always the responsibility of the customer. The customer is therefore strongly encouraged to return the package by any means that provides proof of its dispatch and giving it a certain date (registered with acknowledgment of receipt, colissimo followed, etc.). Otherwise, MAISON MASARIN will not be able to process your return.

If the return is due to an error on our part (bad  received or defective item), MAISON MASARIN will cover your return costs. for this, we invite you to contact customer service by email at hello @maisonmasarin.com.

Once the goods have been received, checked and accepted by our departments, MAISON MASARIN will reimburse the customer for the price of the returned products or issue them a credit note valid for 6 months on the site, at the latest within 10 working days of receipt of the products. .

If your item appears to have a defect upon receipt, we invite you to contact us without delay at hello @maisonmasarin.com . so that a solution can be considered together:
- A repair at our expense 
- An exchange with the same part if the item is irreparable (subject to available stocks) 

 

Our order-exchange and postage reimbursement policy is only applicable for 2 orders (an initial order and an order-exchange).

When an order has been placed with a reduction coupon, the value of the reduction coupon will be deducted from the amount of the refund in proportion to the number of items ordered.

When an order has been placed with a credit note, the returned products cannot be refunded. Only the exchange or credit will be authorized.

ARTICLE 9 – WARRANTY AND LIABILITY


The articles marketed on the site  www.maisonmasarin.com   are subject to the warranty conditions provided for by law.

MAISON MASARIN cannot be held liable:
– in the event of breach of contractual obligations due to a fortuitous event or a case of force majeure;
– in the event of non-substantial differences between the photos, texts and illustrations of the articles on our site and the articles ordered.

ARTICLE 10 – DATA CONFIDENTIALITY


MAISON MASARIN manages an electronic file which lists certain personal data relating to its customers. When an order is placed on the site  www.maisonmasarin.com   by any new customer, this database is enriched by means of information concerning him, which will subsequently make it possible to better meet their expectations and facilitate the assistance services provided by the MAISON MASARIN Customer Relations Department.

This database has been the subject of a declaration, in accordance with the requirements of the law relating to data processing, files and freedoms of January 6, 1978, amended by the law of August 6, 2004.

ARTICLE 11 – INTELLECTUAL PROPERTY RIGHTS


The MAISON MASARIN brand, illustrations, logos and slogans, designs and models appearing on the site are and will remain the exclusive property of MAISON MASARIN. Any total or partial reproduction, without the express prior consent of MAISON MASARIN, is strictly prohibited pursuant to Articles L 335-2 and L 335-3 of the Intellectual Property Code and constitutes an infringement and an offence.

ARTICLE 12 – APPLICABLE LAW


These general conditions of sale and the commercial relationship between MAISON MASARIN and the customer are governed by French law. Any dispute relating to the commercial relationship between MAISON MASARIN and the customer will be subject to the jurisdiction of the French courts.
